These Terms of Service govern your use of the Care Club platform and marketing website. Care Club is a financial wellness platform operated from Utah that connects members with a dedicated licensed advisor and provides access to a financial assessment, educational resources, and member benefits. By creating an account or using Care Club in any way, you agree to these Terms. If you do not agree, do not use the platform.
We've written these Terms to be readable. If something is unclear, contact us at team@trycareclub.com and we'll explain it.
To use Care Club, you must be at least 18 years old, a resident of the United States, and capable of entering into a legally binding agreement. By using Care Club, you represent that you meet these requirements. Care Club does not knowingly provide services to minors. If we learn that a user is under 18, we will deactivate their account promptly.
Care Club is a financial wellness platform. We connect you with a dedicated licensed insurance professional (your advisor), provide a financial assessment that helps you understand your financial picture, offer educational resources about financial products and strategies, and facilitate access to member benefits through third-party partners.
Care Club is not a registered investment advisor under the Investment Advisers Act of 1940 or any state equivalent. Care Club does not provide investment advice, securities recommendations, legal advice, or tax advice. Nothing on the Care Club platform — including assessment results, educational content, advisor conversations, or any other content — constitutes investment advice, a securities recommendation, a legal opinion, or a tax opinion.
Your Care Club advisor is a licensed insurance professional. Any guidance they provide is educational and informational in nature and reflects their role as a licensed insurance agent, not as a fiduciary investment advisor. You should consult a licensed attorney, CPA, or registered investment advisor for legal, tax, or investment advice specific to your situation.
Your Care Club advisor may earn commissions or other compensation if you purchase an insurance or financial product as a result of your advisor relationship. This compensation comes from the product provider, not from you directly. Care Club earns referral fees or affiliate commissions when members use certain third-party partner services. In accordance with FTC guidelines, we disclose that these commercial relationships exist. The existence of compensation arrangements does not obligate you to purchase any product.
To use Care Club, you must create an account with accurate, current, and complete information. You agree to keep your account information up to date. You may not create an account using false information or on behalf of someone else without their explicit permission.
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at team@trycareclub.com if you suspect unauthorized access to your account. Care Club is not liable for losses resulting from unauthorized use of your account due to your failure to keep credentials secure.
Care Club accounts are for individual use. You may not share your account with another person or create multiple accounts for the same individual. Care Club membership covers one account holder — family members who wish to use Care Club must create their own accounts.
When you join Care Club, you are assigned a dedicated advisor. Your advisor is an independent licensed insurance professional — they are not an employee of Care Club. Care Club facilitates the relationship and provides the platform through which your advisor serves you, but your advisor operates independently.
Care Club does not guarantee specific outcomes from the advisor relationship. Results depend on your individual financial situation, the products available to you, your engagement with the platform, and decisions you make. Care Club does not guarantee that your advisor will be available at any specific time, though advisors are expected to be responsive during normal business hours.
If you have a concern about your advisor's conduct, contact us at team@trycareclub.com. Care Club takes advisor conduct seriously and will investigate reported concerns.
Nothing in the advisor relationship creates a fiduciary duty on the part of Care Club or your advisor unless explicitly established under applicable state insurance law.
Care Club is available on two subscription plans: Monthly at $49 per month, and Annual at $470 per year. Both plans include identical features and access. Pricing is subject to change with advance notice to active members.
Subscriptions are billed through Stripe, Inc. By subscribing, you authorize Care Club to charge your payment method on a recurring basis (monthly or annually) until you cancel. Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date.
You may cancel your Care Club subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain full access through that date. We do not offer refunds for partial billing periods. Annual subscribers who cancel mid-year retain access through the end of the annual period for which they paid.
If a payment fails, Care Club will attempt to notify you by email and retry the charge. If payment cannot be collected after reasonable attempts, your account may be suspended or deactivated. You can reactivate by updating your payment information and settling any outstanding balance.
If Care Club changes subscription pricing, we will notify active members via email at least 30 days before the change takes effect. Price changes apply at your next renewal date after the notice period. If you do not agree to a price change, you may cancel before your next renewal.
Care Club provides access to member benefits through third-party partners, including will preparation, tax filing, credit monitoring, identity theft protection, and comprehensive wealth planning. These benefits are provided by independent third parties and are subject to their own terms of service and privacy policies.
Care Club does not control third-party benefit providers and is not responsible for their services, availability, quality, or terms. Care Club earns affiliate commissions or referral fees from some third-party partners. The existence of these arrangements does not affect the benefits available to you or require you to use any particular service.
Member benefits may change over time as partner relationships evolve. Care Club will notify active members of material changes to the benefits included in their membership.
Care Club's financial assessment is designed to provide directional, educational estimates based on the information you enter, and to generate personalized product matches for you to review.
Assessment results and product matches are approximations. They are not financial plans, investment recommendations, insurance applications, legal documents, or professional advice of any kind. Results are based solely on the information you provide and use simplified calculations. Your actual financial situation may differ materially from what the assessment suggests.
Your assessment results are shared with your assigned advisor to facilitate the advisory relationship. By completing the assessment, you consent to your advisor viewing your results.
You agree to use Care Club only for lawful purposes and in accordance with these Terms. You agree not to:
Care Club reserves the right to suspend or terminate accounts that violate these terms without prior notice.
All Care Club content, branding, platform design, assessment tools, educational materials, and software are owned by or licensed to Care Club and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any Care Club content without our prior written permission.
Your use of Care Club does not grant you ownership of any platform content or intellectual property. You retain ownership of the personal information and responses you submit through the platform.
Your use of Care Club is also governed by our Privacy Policy, available at trycareclub.com/privacy. By using Care Club, you agree to the collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
By creating a Care Club account, you consent to receive emails from Care Club related to your account, including a welcome email, an onboarding email sequence, and account notifications. You may unsubscribe from non-essential emails at any time.
Care Club does not send marketing text messages. If you receive a text message related to your Care Club advisor relationship, it is sent directly by your advisor as an independent licensed professional, not by Care Club's systems. Standard message and data rates may apply to any text communications with your advisor. You may ask your advisor to communicate with you by other means at any time.
Care Club is provided on an 'as is' and 'as available' basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.
Care Club does not guarantee any financial outcomes, advisor availability guarantees beyond reasonable responsiveness, or specific results from the use of assessment tools or the advisor relationship. Financial decisions you make based on Care Club content or advisor conversations are your own responsibility.
To the maximum extent permitted by applicable law, Care Club and its founders, employees, advisors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform — including but not limited to loss of data, loss of income, or financial losses — even if Care Club has been advised of the possibility of such damages. Care Club's total liability to you for any claim arising from your use of the platform shall not exceed the amount you paid to Care Club in the 12 months preceding the claim.
Before filing any formal legal claim, you agree to contact Care Club at team@trycareclub.com and describe the dispute in writing. We will attempt to resolve it informally within 30 days. Most concerns can be resolved this way.
If informal resolution fails, you and Care Club agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Care Club platform through binding individual arbitration, rather than in court. This means you waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration.
Arbitration shall be conducted by a mutually agreed-upon arbitrator or, if no agreement is reached, under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitration shall take place in Utah or remotely. The arbitrator's decision shall be final and binding.
Either party may bring an individual claim in small claims court. Either party may seek emergency injunctive relief from a court to prevent irreparable harm while arbitration proceeds. This arbitration agreement does not apply to claims that applicable law specifically exempts from mandatory arbitration.
You agree that any dispute resolution proceeding will be conducted only on an individual basis. You waive any right to bring or participate in a class, consolidated, or representative action against Care Club.
These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Utah.
You may cancel your Care Club account at any time from your account settings. Upon cancellation, your access continues through the end of your current billing period.
Care Club reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that harms other users or the platform. In cases of termination for cause, no refund will be issued. In cases of termination without cause by Care Club, a pro-rated refund of any prepaid unused subscription period will be issued.
Upon termination, your right to access the platform ends. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and dispute resolution — shall survive.
Care Club may update these Terms from time to time. When we make material changes, we will notify active members via email at least 14 days before the changes take effect. The updated Terms will always be available at trycareclub.com/terms. Your continued use of Care Club after the effective date constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you may cancel your account before they take effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Care Club regarding the platform and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Care Club's failure to enforce any right or provision does not constitute a waiver of that right or provision. You may not assign your rights under these Terms without Care Club's written consent. Care Club may assign its rights in connection with a merger, acquisition, or sale of assets.
